Terms of Service
1. Introduction
1.1. Welcome to Steed Equine Monitoring Solutions OÜ. These Terms of Service ("Terms") govern your use of the Steed Device and companion App. for device activation and usage (the "Steed app", “App”, “app.”, “Device”) including any purchases made on the Steed website online store. By accessing or using the Steed Device and Steed app., you agree to be bound by these Terms.
1.2. To use the Device and companion app., you are required to create an account and pay for a subscription, provide certain information about yourself and your horses. You agree to provide accurate and complete information when creating your account and to keep your account information up to date and subscription in order.
1.3. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2. Oders
2.1. By placing an order on the Steed online store, you represent and warrant that you are at least 18 years old or have obtained parental or guardian consent to make purchases on the Steed online store.
2.2. All subscriptions made through the Steed online store are subject to availability. We reserve the right to limit or cancel quantities of any products or services ordered.
2.3. Pricing for products and services offered on the Steed online store is subject to change without notice. All prices are in $USD and/or Euros and do not include shipping, handling, or taxes unless otherwise indicated.
3. Use and Ownership of the Steed Device
3.1. The paid subscription grants the customer the right to use the Steed device ("Device") during the term of the subscription. The Device is provided to the customer for use under the subscription and remains the property of Steed Equine Monitoring Solutions ("Steed").
3.2. The customer acknowledges and agrees that the subscription does not transfer any ownership rights of the Device to the customer. The customer shall not sell, lease, transfer, or assign any interest in the Device.
3.3. Upon termination or expiration of the subscription, the customer agrees to return the Device to Steed in its original condition, normal wear and tear excepted. Steed reserves the right to charge the customer for any damage to the Device beyond normal wear or if the Device is not returned within [specified number of days] of subscription termination.
3.4. Steed reserves the right to take legal action to recover the Device if it is not returned as required.
4. Payment
4.1. Payment for subscriptions made on the Steed online store must be made in full at the time of purchase. We accept payment through Stripe.
4.2. You agree to provide accurate and complete payment information when making a purchase through the Steed online store. By providing payment information, you represent and warrant that you have the legal right to use any payment method(s) provided.
4.3. Your subscription will be automatically renewed unless you inform us in writing or email of your wish to cancel the subscription.
5. Shipping and Delivery
5.1. We will make reasonable efforts to fulfill and deliver orders in a timely manner. However, we do not guarantee delivery dates and are not responsible for delays caused by third-party shipping carriers.
5.2. Shipping costs and delivery times vary depending on the shipping method selected and the destination. Shipping costs will be calculated and displayed at checkout.
6. Returns and Refunds
6.1. If you are not completely satisfied, you may return the Device(s) for a refund within 30 days of purchase, subject to the terms of our Returns and Refunds Policy.
7. Intellectual Property
7.1. All content included in the Device and companion app., including but not limited to text, graphics, logos, images, hardware and software, is the property of Steed Equine Monitoring Solutions OÜ or its licensors and is protected by copyright, trademark, and other intellectual property laws.
7.2. You may not use, reproduce, distribute, or modify the Device under any circumstances or any content from the Steed companion app. without the express written consent of Steed.
8. Limitation of Liability
8.1. In no event shall Steed, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Device and companion app., whether based on warranty, contract, tort (including negligence), or any other legal theory.
9. Governing Law
9.1. These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.
10. Changes to These Terms
10.1. We reserve the right to update or change these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Steed website and companion app. Your continued use of the Device and companion app. following the posting of any changes constitutes acceptance of those changes.
